These Terms and Conditions govern your use of GW Murphy, Inc. and its affiliated brands and websites. By continuing to use our services, you acknowledge and accept these terms and conditions. Please read them carefully.

Section 01

Terms of Payment

Interest shall be charged at the rate of 2% per month or proportionally for parts of a month after 30 days from receipt of materials per invoice.

No credit will be given on any returned items until they are inspected by GW Murphy, Inc. at its facility. Such inspection will determine the amount of credit that will be given for merchandise deemed to be damaged. Any such merchandise shall be held for the customer per its instructions. Any shipping of such merchandise by the company shall be at the customer's expense.

Waiver by GW Murphy, Inc. of strict compliance with any of the terms of this sale is not to be considered a waiver of the customer's obligations.

GW Murphy, Inc. liability shall be limited solely to the replacement of, or refund of, the purchase price of the material that has been returned, provided that any such material shall be returned to GW Murphy, Inc. Cost of freight or delivery will not be reimbursed.

In the event that any balance due and owing for the materials supplied herein shall be payable for a period in excess of 30 days, the customer shall be responsible for the interest stated above, in addition to the cost of collection, including reasonable attorney fees and court costs.

Section 02

Shipping Terms

All shipments will be made F.O.B. our dock, freight pre-paid, unless other arrangements have been made by the buyer. No freight allowance will be made for pick-up at the factory or warehouse.

Responsibility for shipment on the part of GW Murphy, Inc. ends at the time the carrier accepts the goods for shipment.

GW Murphy, Inc. has no liability for loss or damage in transit.

Section 03

Delays

All orders and contracts are accepted and scheduled subject to revision in accordance with GW Murphy, Inc.'s ability to procure the necessary material, labor, fuel, power and supplies. All schedules are subject to:

  • Government regulations and requirements
  • Force majeure and acts of God
  • War, strikes, lock-outs, floods, accidents and fires
  • Riots, civil commotion and acts of belligerent powers
  • Delays or interruption in transportation of any kind
  • Other contingencies beyond GW Murphy, Inc.'s control

All orders and contracts are also subject to current factory shipping schedules.

Section 04

Return of Merchandise

No merchandise may be returned to GW Murphy, Inc. without authorization and shipping instructions from GW Murphy, Inc. A return authorization number must be secured from GW Murphy, Inc. before returning any merchandise.

The amount of credit, if any, for returned merchandise and handling charges will be determined by the company upon inspection of the returned merchandise.

Section 05

Cancellations

Any order, once placed with and accepted by GW Murphy, Inc., can be canceled only with GW Murphy, Inc.'s consent and is subject to cancellation charges, including a 25% handling charge.

Section 06

Shortages

Any claims for shortages must be made at time of receipt. No claims will be allowed if not made in accordance with the foregoing as to time and in writing. All shortages must be documented on original paperwork at time of receipt.

Section 07

Clerical Errors

All stenographic and clerical errors are subject to correction.

Section 08

Shipment

Each shipment shall be treated as a separate and distinct contract. However, if buyer shall fail to fulfill the terms of payment, GW Murphy, Inc. may, without prejudice to any other lawful remedy, defer further shipments until payment is made on prior shipments, or may cancel the contract and stop the goods in transit.

Section 09

Insolvency of Buyer

If the buyer shall make assignment for the benefit of creditors, or a voluntary or involuntary petition or other action in bankruptcy or for reorganization or under any other insolvency law shall be filed by or against the buyer, or the buyer shall admit its inability to pay its debts, or a trustee, receiver, or liquidator is appointed for any part of the assets of the buyer, then GW Murphy, Inc. may, at its option:

  • Immediately terminate further compliance with any orders from the buyer
  • Stop goods in transit and have them shipped to GW Murphy, Inc.'s warehouse
  • Require that unpaid inventories be immediately reshipped to GW Murphy, Inc. to help offset outstanding debt
Section 10

Acceptable Use

  • Users must use our services in a lawful and respectful manner.
  • Any misuse, including unauthorized access, data scraping, or distribution of malicious content, is strictly prohibited.
Section 11

Limitations of Liability

GW Murphy, Inc. shall not be held liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use our services. We do not guarantee uninterrupted or error-free service and are not responsible for any data loss or system failures.

Section 12

User Responsibilities

  • Users are responsible for maintaining the confidentiality of their account information.
  • Users must ensure that any data provided to GW Murphy, Inc. is accurate and up-to-date.
  • Users must notify us immediately of any unauthorized use of their account or security breach.
Section 13

Messaging Terms

By registering, users agree to receive communications from GW Murphy, Inc., which may include:

  • Appointment reminders
  • Order alerts
  • Account notifications
